These Terms of Service ("Terms") constitute a legally binding agreement between you ("you," "your," "User") and Cash Map LLC dba Price Cam, a Wyoming limited liability company with foreign entity status in New York ("Pricecam," "Company," "we," "us," or "our"). These Terms govern your access to and use of the Pricecam mobile application, website, and any related services (collectively, the "Service").
By accessing, downloading, installing, or otherwise using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must not use the Service.
1.1 The Service is made available worldwide without a minimum age requirement. The Service is intended for use by individual consumers, businesses, and resellers.
1.2 By using the Service, you represent and warrant that you have the right, authority, and capacity to enter into these Terms and to abide by all of the terms and conditions herein.
2.1 To access certain features of the Service, you are required to create an account. You may register by providing a valid email address and password, or by using third-party authentication providers (e.g., Google, Apple).
2.2 You agree to provide true, accurate, current, and complete information during the registration process and to maintain and promptly update such information.
2.3 You are solely responsible for maintaining the confidentiality and security of your account credentials. You agree that you will not share your account or password with any third party. You further agree that you are fully responsible for all activities that occur under your account, whether or not authorized by you.
2.4 Pricecam shall not be liable for any loss or damage resulting from your failure to comply with this Section.
3.1 The Service enables Users to: (a) Upload photographs of video games; (b) Utilize artificial intelligence technology to identify game titles; and (c) Access price information by cross-referencing identified titles with third-party databases.
3.2 The Service currently does not facilitate direct transactions (buying or selling). Certain premium features may require a paid subscription, as further described below.
3.3 Pricecam reserves the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice.
3.4 Beta Access and Transition to Paid Subscription
3.4 During the beta period, the Service is offered to Users free of charge ("Beta"). Pricecam may limit Beta availability, features, or access at any time and may end the Beta period in its sole discretion.
3.5 Upon the conclusion of the Beta period, the Service will no longer be free and will require payment under a subscription model (including, where applicable, automatically renewing subscriptions) unless otherwise stated by Pricecam in writing. Pricecam will provide notice within the Service, via the applicable app store listing, or by other reasonable means before the transition from Beta access to paid subscription access.
3.6 If you do not wish to pay for a subscription after Beta ends, you must discontinue use of the Service and may delete your account at any time as described in Section 9.
4.1 During the beta phase, access to the Service is free of charge. Pricecam reserves the right to introduce subscription fees at its sole discretion.
4.2 Subscription payments will be processed through applicable third-party app stores (e.g., Apple App Store, Google Play). Your purchase is also subject to the app store's terms and conditions.
4.3 Refunds will be issued only in the following circumstances: (a) where required by applicable law, or (b) where the Service fails to function as intended (e.g., persistent crashes or technical malfunctions). Refunds will not be provided for reasons of personal preference, dissatisfaction, or change of mind.
4.4 Pricecam reserves the right to change its pricing structure at any time, provided that any such changes shall not apply retroactively to already-purchased subscriptions.
5.1 You retain all rights, title, and interest in and to the content you upload, including photographs and associated data ("User Content").
5.2 By uploading User Content, you grant to Pricecam a worldwide, royalty-free, non-exclusive, transferable, sublicensable license to host, use, reproduce, modify, analyze, and display such content for the purposes of operating, improving, and promoting the Service.
5.3 You represent and warrant that: (a) you have all necessary rights to submit the User Content, and (b) such User Content does not violate any applicable law or infringe upon any intellectual property or other rights of third parties.
5.4 Pricecam reserves the right, but not the obligation, to remove any User Content that violates these Terms or that it deems objectionable in its sole discretion.
6.1 Except for User Content, all materials within the Service, including but not limited to software, algorithms, text, graphics, images, trademarks, and logos, are owned by Pricecam and are protected under intellectual property laws.
6.2 You agree not to copy, modify, distribute, sell, lease, reverse engineer, decompile, or otherwise attempt to derive the source code or underlying structure of the Service.
6.3 Unauthorized use of the Service or infringement of Pricecam's intellectual property rights may result in account termination and legal action.
7.1 THE SERVICE, INCLUDING ALL INFORMATION, CONTENT, AND FUNCTIONALITY PROVIDED THEREIN, IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND.
7.2 PRICECAM DISCLAIMS ALL EXPRESS, IMPLIED, OR STATUTORY WARRANTIES, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
7.3 Without limiting the foregoing: (a) Pricecam does not warrant that the Service will be uninterrupted, error-free, or secure; (b) Pricecam does not guarantee the accuracy, completeness, or timeliness of pricing or product information; market prices fluctuate, and artificial intelligence may produce inaccurate results; (c) You acknowledge and agree that reliance on such information is at your own risk.
8.1 TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL PRICECAM, ITS AFFILIATES, OR THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST DATA, OR LOSS OF GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.
8.2 IN NO EVENT SHALL PRICECAM'S TOTAL CUMULATIVE LIABILITY TO YOU EXCEED THE GREATER OF: (A) FIFTY U.S. DOLLARS (USD $50), OR (B) THE AMOUNT ACTUALLY PAID BY YOU TO PRICECAM FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
9.1 Pricecam may suspend or terminate your account and access to the Service, with or without notice, if you violate these Terms, engage in fraudulent or unlawful activity, or otherwise misuse the Service.
9.2 You may terminate your account at any time by following the instructions within the Service or by contacting Pricecam at the email listed below.
9.3 Upon termination, all provisions of these Terms which by their nature should survive, shall survive, including but not limited to intellectual property, disclaimers, limitations of liability, and governing law.
10.1 Your use of the Service is subject to our separate Privacy Policy, which governs the collection, use, and disclosure of your personal information. By using the Service, you consent to our data practices as described therein.
11.1 These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of law principles.
11.2 You agree to submit to the exclusive jurisdiction of the state and federal courts located in Wyoming to resolve any legal matter arising from these Terms or your use of the Service.
12.1 Pricecam reserves the right, in its sole discretion, to amend, modify, or update these Terms at any time.
12.2 If changes are material, we will provide notice by posting the updated Terms within the Service or by other reasonable means.
12.3 Your continued use of the Service following any such modification constitutes your acceptance of the revised Terms.
